Terms of Service for Stryked

Welcome to Stryked: By downloading, installing, or using the Stryked mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and Stryked ("we", "us", or "our"). By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. For how we use platform technology (location, maps, and interactions), see our Technology & Platform Use page.
If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
Stryked is a location-based mobile application that enables users to:
- Discover and visit real-world trophy locations
- Complete challenges and earn achievements
- Share photos and experiences through Snapventures
- Compete on leaderboards and track progress
- Connect with other users and view their achievements
- Unlock and redeem optional real-world partner rewards at participating locations, where offered
3. User Accounts
3.1 Account Creation
- You must create an account to use certain features of the App
- You must be at least 16 years old to create an account. In the European Economic Area (EEA), including the Netherlands, the minimum age is 16, in line with the GDPR age of digital consent for processing personal data (such as location data). We do not knowingly collect personal data from anyone under 16
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to provide accurate, current, and complete information during registration
3.2 Account Security
- You are responsible for all activities that occur under your account
- You must immediately notify us of any unauthorized use of your account
- We are not liable for any loss or damage arising from unauthorized access to your account
3.3 Account Termination
- You may delete your account at any time through the App settings
- We reserve the right to suspend or terminate your account for violations of these Terms
- Upon termination, your right to use the App will immediately cease
4. Acceptable Use
4.1 Permitted Uses
You agree to use the App only for lawful purposes and in accordance with these Terms. You may:
- Use the App for personal, non-commercial purposes
- Share your experiences and achievements with other users
- Participate in challenges and competitions in good faith
4.2 Prohibited Activities
You agree NOT to:
- Location Spoofing: Use location spoofing tools, GPS manipulation software, or any method to falsify your location
- Cheating: Use automated scripts, bots, or any unauthorized third-party software to gain unfair advantages
- Harassment: Harass, threaten, or abuse other users
- Inappropriate Content: Post offensive, illegal, or inappropriate content, including but not limited to:
- Hate speech, discrimination, or harassment
- Violence, threats, or intimidation
- Sexually explicit or pornographic content
- Content that infringes on intellectual property rights
- Impersonation: Impersonate any person or entity or falsely claim affiliation with any person or entity
- Data Mining: Scrape, crawl, or extract data from the App without authorization
- Reverse Engineering: Attempt to reverse engineer, decompile, or disassemble the App
- Interference: Interfere with or disrupt the App's servers, networks, or security features
- Multiple Accounts: Create multiple accounts to circumvent restrictions or gain unfair advantages
- Commercial Use: Use the App for any commercial purpose without our written consent
5. Location Services and Safety
5.1 Location Tracking
- The App requires access to your device's location services to function
- You are responsible for your own safety when visiting trophy locations
- We do not guarantee the safety, accessibility, or legality of any trophy location
- Always follow local laws, regulations, and property rights when visiting locations
5.2 Safety Disclaimer
IMPORTANT: Visiting trophy locations may involve risks, including but not limited to:
- Physical injury from travel or terrain
- Exposure to dangerous or hazardous conditions
- Legal consequences for trespassing or violating property rights
- Adverse weather conditions
You acknowledge and agree that you visit trophy locations at your own risk. We are not responsible for any injuries, damages, or legal consequences resulting from your use of the App or visits to trophy locations.
5.3 Trophy Locations: Accuracy, Access, and Curation
5.3.1 GPS and Placement Inaccuracies
The App displays locations based on GPS coordinates and external data sources. We do not guarantee that these coordinates are 100% accurate, current, or error-free. Errors in the placement of a trophy do not entitle you to compensation.
5.3.2 Private Property and User Discretion
The appearance of a virtual trophy at a particular location does not mean that location is publicly accessible. If a trophy is on private property, behind a fence, or on dangerous terrain, you must not enter that location. Your own judgment and respect for physical barriers always take precedence over what is shown in the App.
5.3.3 No Duty to Verify or Maintain Locations
We are not obliged to check, verify, or maintain in advance the physical status, accessibility, or safety of trophy locations.
6. Intellectual Property
6.1 Our Rights
- The App, including its design, features, and content, is owned by Stryked and protected by copyright, trademark, and other intellectual property laws
- You may not copy, modify, distribute, or create derivative works based on the App without our written permission
- All trademarks, service marks, and logos are the property of their respective owners
6.2 Your Content
- You retain ownership of photos, text, and other content you upload to the App ("User Content")
- By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content within the App
- You represent and warrant that you have all necessary rights to grant this license
- You are responsible for ensuring your User Content does not infringe on the rights of others
6.3 Content Moderation and Reporting (Digital Services Act)
Because users can share photos and experiences through Snapventures and other features, Stryked acts as a hosting service under the EU Digital Services Act (DSA). We are committed to addressing illegal or inappropriate User Content.
- Reporting: You can report User Content that you believe is illegal, inappropriate, harassing, or infringes copyright or other rights by emailing support@getstryked.com or using the in-app report option on Snapventures and related content
- Notice and takedown: When we receive a valid report or notice of illegal content, we may review the reported content and remove or restrict access to it without prior notice, where required or permitted by law
- Repeat violations: We may suspend or terminate accounts that repeatedly upload prohibited content, as described in Section 9
7. In-App Purchases and Subscriptions
7.1 Purchases
- The App may offer in-app purchases, including subscriptions and one-time purchases
- All purchases are processed by Apple through the App Store
- Prices are displayed in your local currency and may vary by region
- All sales are final unless required by applicable law
- Right of withdrawal (EEA consumers): If you are a consumer in the European Economic Area, you generally have a 14-day right to withdraw from distance contracts for digital content. By purchasing digital content or subscriptions and requesting immediate delivery or access, you agree that the digital content or service is provided immediately and you acknowledge that you lose your statutory right of withdrawal once delivery has begun, to the extent permitted by applicable law
7.2 Subscriptions
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- You can manage or cancel subscriptions through your Apple ID account settings
- We reserve the right to change subscription prices with reasonable notice
- Refunds are subject to Apple's refund policy
8. Partner Rewards
Some trophy routes or partner locations may offer optional real-world rewards ("Partner Rewards"), such as vouchers, discount codes, complimentary items, or other benefits supplied by independent third-party partners.
8.1 Stryked as Intermediary
- Stryked provides the App, validates whether you have met in-game unlock conditions, and facilitates QR-based redemption verification. We act as an intermediary, not as the seller, supplier, or issuer of Partner Rewards.
- The partner that offers a reward is solely responsible for providing, honouring, and fulfilling the reward at their premises or through their own systems, subject to their own terms and availability.
- Partner Rewards are not in-app purchases, digital content sold by Stryked, or lottery or gambling products. They are not processed through Apple or the App Store.
8.2 How Rewards Are Earned and Redeemed
- Unlock conditions are based on gameplay (for example, visiting specified trophies or completing a sequence). Rewards are not awarded by random chance, loot boxes, or lotteries.
- When you unlock an offer, the App may generate a QR code for you to present to the partner for redemption. Redemption is validated on our servers; partners cannot rely on screenshots or altered codes alone.
- QR codes are short-lived (typically valid for 15 minutes from generation). For sequential routes, redemption must usually occur within 24 hours of your last qualifying trophy visit, unless a different period is shown in the App or by the partner.
- Each offer can normally be redeemed once per user. Additional conditions (such as opening hours, stock limits, or partner-specific rules) may apply and are displayed where available.
8.3 No Cash Value; Non-Transferable
- Partner Rewards have no cash value, are not legal tender, and cannot be exchanged for money or in-app currency through Stryked unless a partner explicitly offers cash-equivalent settlement under their own rules.
- Rewards are linked to your account and are not transferable unless the partner expressly allows otherwise.
- Stryked does not refund, replace, or compensate you for unredeemed Partner Rewards except as required by mandatory consumer protection law.
8.4 Expiry, Changes, and Withdrawal of Offers
- Partners may set expiry dates, quantity limits, or other conditions shown in the App or at the point of redemption.
- We or a partner may modify, suspend, or withdraw an offer before redemption if it was misconfigured, abusive, fraudulent, unlawful, or contrary to these Terms.
- Expired or invalid QR codes cannot be redeemed. Whether you can obtain a new QR code depends on the offer rules and your continued eligibility.
8.5 Partner Refusal, Insolvency, and Unredeemed Rewards
- If a partner refuses to honour a valid redemption, is closed, becomes insolvent, or otherwise cannot fulfil a reward, Stryked is not liable for the unredeemed or unfulfilled reward beyond our reasonable efforts to help resolve the issue with the partner.
- We do not guarantee the availability, quality, safety, or fitness of any Partner Reward or of any goods or services supplied by a partner.
- If you believe you met the unlock conditions but could not redeem, contact support@getstryked.com. We will investigate in good faith but cannot compel a third party to provide goods or services outside their agreement with us.
8.6 Limitation of Liability for Partner Rewards
To the maximum extent permitted by law, Stryked's liability relating to Partner Rewards is subject to the limitations in Section 10.2. Nothing in this section excludes or limits liability that cannot be excluded or limited under mandatory consumer protection law (including for death or personal injury caused by negligence, fraud, or gross negligence).

9. Anti-Spoofing and Enforcement
9.1 Anti-Spoofing Measures
- We employ automated systems to detect location spoofing and cheating
- These systems analyze movement patterns, device sensor data, and other indicators
- Violations may result in temporary or permanent bans
9.2 Enforcement Actions
If you violate these Terms, we may take one or more of the following actions:
- Issue warnings
- Temporarily suspend your account (typically 24 hours for first violations)
- Permanently ban your account for repeated or severe violations
- Remove or modify your User Content
- Take legal action if necessary
9.3 Appeals
- If you believe you were incorrectly banned, you may appeal by contacting support@getstryked.com
- We will review ban appeals within 24 hours
- Our decision on appeals is final
10. Disclaimers and Limitations of Liability
10.1 Service Availability
- The App is provided "as is" and "as available" without warranties of any kind
- We do not guarantee that the App will be uninterrupted, error-free, or secure
- We reserve the right to modify, suspend, or discontinue the App at any time
10.2 Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the greater of (a) the amount you paid for in-app purchases in the 12 months preceding the claim, or (b) EUR 50
- We are not responsible for any loss or damage resulting from:
- Your use or inability to use the App
- Visiting trophy locations
- Interactions with other users
- Unauthorized access to your account
- Errors or omissions in the App
These limitations of liability apply to the fullest extent permitted by law, but do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under mandatory consumer protection law (including liability for our gross negligence or willful misconduct).
10.3 Jurisdiction-Specific Terms
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Stryked, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another user or third party
- Your User Content
12. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

13. Third-Party Services
The App may integrate with third-party services, including:
- Apple Services: App Store, Sign in with Apple, in-app purchases
- Apple Maps (MapKit): Map display and location-based features. Your use of map data is subject to Apple Maps Terms of Service and Apple's applicable privacy policies
- Firebase/Google: Authentication, database, hosting, analytics
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes:
- The "Last Updated" date at the top will be changed
- Significant changes will be announced in the App
- Continued use of the App after changes constitutes acceptance of the updated Terms
- If you do not agree to the changes, you must stop using the App and delete your account
15. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:
- Violation of these Terms
- Fraudulent, illegal, or harmful activity
- At our sole discretion
Upon termination, your right to use the App will immediately cease, and we may delete your account and User Content.
16. Governing Law and Dispute Resolution
16.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
16.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- Good faith negotiation — contact us at support@getstryked.com
- EU consumers may use the EU Online Dispute Resolution (ODR) platform to submit complaints
- If negotiation fails, submission to the exclusive jurisdiction of the competent court in the district of Zeeland-West-Brabant, location Breda, the Netherlands
- You waive any right to participate in a class-action lawsuit or class-wide arbitration, to the extent permitted by applicable law
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stryked regarding your use of the App and supersede all prior agreements and understandings.
